Abstract
The article aims to present how the personality of the unborn child is treated by the classical theory of law and determine whether such reasoning could
be applied to the embryo. It also intends to provide the legal framework and allocation rules. The human embryo is subject to guardianship, but the law does
not impute legal situations.
